This is filed under penalty of perjury, meaning that there is a real risk for Wheeler if it's knowingly and also a key thing that I have to mention here is that there is a House Ethics Committee rule that bars a committee from accepting
nonmember complaints within 60 days of election, where the subject is a candidate and Boebert is up for reelection in We're gonna have to see how all this shakes out.
But over the past few days, we've also seen Boebert responding to the allegations with multiple statements Right.
In one comment she said, well, I'm not a lesbian or bisexual and I have never, ever been in any inappropriate relationship, nor have I ever been sexually involved with any staff.
also had a spokesperson for Boebert saying that she rejects these allegations is utterly false and saying there is no truth to them whatsoever.
calling it nothing more than a politically motivated stunt designed to manipulate the ethics process, create headlines, smear her and generate with the matting.
That this complaint came from an activist who has long recycled sensational claims, including numerous baseless accusations, previously fact checked as And then last night, you had Boebert

Remember all those headlines from just a few weeks ago about how I is going to kill humanity?
now I companies appear to be getting sued for trying to do something to stop that from happening. With a lot of this.
Started when that employee who resigned from anthropic wrote that the people building. I earnestly believe that it could kill us all by the end of the decade. within much of the AI industry, instead of saying, no, that's ridiculous.
Hey, we're on it, saying earnestly, we do believe that I could kill all humans.
it got to the point that anthropic CEO wrote an essay calling for leaders to slow the pace at which we improve the capabilities of AI models.
a bunch of AI leaders openly agreeing to the plan, OpenAI, Sam Altman writing that AI progress should be slower than it otherwise could be, arguing no amount of American competitive pressure should justify recklessness or let capabilities get ahead of alignment and monitoring.
and we've had this debate playing out online of if they actually care about people or this is just a way to try and slow down competitors to some degree so they can, you know, really monopolize together, whatever
the case is, you now have a lawsuit that's challenging this, arguing that this joint effort amounts to conspiracy and violates antitrust laws.
you've got the lawyer for the plaintiffs saying that I will quickly spin out of human control and kill us all if we allow AI safety and protocol to be controlled by private, self-serving agreement between the world's most powerful for profit technology companies.
the plaintiffs who are suing are for paid subscribers of ChatGPT Claude Rock and Gemini, and they're seeking a class action status on behalf of other subscribers,
with the lawsuit specifically filed against anthropic OpenAI space AI and Google.
you've had the plaintiffs saying that they do believe that I should have guardrails with ethical considerations and direct liability.
but they believe that these guardrails should not be decided by the defendants, but by we the people, through state and federal regulation and through the voices of juries
in our communities, them, then adding the antitrust laws do not permit competitors to decide among themselves that competition is too dangerous, whether frontier I should develop more slowly is a question for each company acting alone or for Congress and the agencies.
Right. So all of this, it connects to the debate we've been seeing play out.

because right now, depending on where you go, the opinions on AI very, very different though, nationally speaking, when you're talking about AI data centers, that's definitely a lot more people are against those right now.

And when we learned that the FAA is going to be rolling out AI air traffic control tools this week.
that, then resulting in a ton of backlash from people who think that that sounds like a recipe for disaster.
We're arguing that this isn't great news to hear after we had people at these AI companies saying, hey, there could be an apocalypse soon. the was far as the specifics here.
The software is called smart standing for strategic management of airspace routes and trajectories.
you got it reportedly designed to analyze airline schedules, weather, runway capacity and other constraints, predict potential conflicts and delays. with it also offering alternative routes for flights.
And it's debuting at three airports in the DC area Ronald Reagan Washington National Airport, Dulles International Airport and Baltimore, Washington International Thurgood Marshall Airport. right.
But after that, it is expected to roll out nationally by 2028.
And according to the Wall Street Journal, fully rolled out across U.S airspace, the software is supposed to act as something like the brains of the nation's air traffic control system.
though I will say with this you have the transportation department stressing that AI is not replacing any human operators or single handedly directing any flights. Right. It's offering recommendations that controllers can listen to or ignore.
but still obviously you have a lot of people that are concerned about AI playing any role in our air traffic operations.
ones where there's, you know, people pointing to things like the recent government shutdown, highlighting just how severe our air traffic controller shortages. rains. You people saying we need to inject technology where it can help.
Other tools need to be developed.
with all this, if the transportation department asking for billions to upgrade its system and this smart AI air traffic software, it's part of an $875 million contract. the one.
So I should note for you here, there are concerns that this tool might not actually address the actual issues that air traffic controllers are dealing with. right.
Because you have experts knowing that most major problems that caused delays happen after a flight plan is filed.
so there's a belief that airlines might cooperate with the program in the beginning of the rollout, but they also might end up dismissing it later, seeing it as an unnecessary FAA intrusion.

but but then from that, we got to talk about why all the major TV networks in the white House press will just suspended their coverage of Trump in solidarity after he randomly decided to ban CNN. Ms..
Now in Politico from the white House. like even Fox News is joining the battle against Trump here right. And all of this, it is truly massive.
For decades, the press pool they've served as an essential window into the president's day to day life and TV. It's a huge part of that. right.
The way that it works is that the pool consists of print reporters, broadcast journalist and photographers who rotate traveling with the president and covering white House events and reads, share footage, photos, audio and quotes with other members of the media.
and it's a system that's made a lot of sense.
So it'd be impossible for every single news outlet to have a team with the president all the time, especially when he's traveling Right. Air Force One only has 13 seats in the press cabin.
and for years now, you've had five networks sharing the responsibility, providing TV coverage for the pool, ABC, CBS, CNN, Fox News and NBC.
on Friday, you had Trump abruptly announcing on Truth Social that he was banning CNN now and Politico from the white House and claiming that the sudden ban was, quote, a result of their constant
reporting fake news and adding Media outlets shouldn't be able to constantly write a report, fiction and lies when they're covering the president of the United States, the Trump administration, or the United States of America, other fake news media outlets to follow.
though like many other Trump policies that have been announced on Truth Social, it was not immediately clear what this ban was going to look like in practice or how long it would last. Right. When pressed by reporters, Trump just said this.
Oh, the ban on the free press, right? A very simple ban. I don't want him in my office.
I don't want him here. I would say the band would go as far as you can.
And if they could straighten themselves out, you know, if they could send them out, I'd love and then the next day you had CNN and Ms..
Now and Politico all saying that their journalists were blocked from entering the white House grounds and that their press passes were confiscated. and while their numbers are diminishing, the Trump cult is still there.
And so you had many supporting this, but also the backlash against Trump was immediate, Where many accusing him of undermining key democratic principles and acting in clear violation of press freedoms that are explicitly protected under the First Amendment of the Constitution.
but then in addition to that, this morning we got more news, With multiple outlets.
Obtaining a memo from Brian Boats in the Washington bureau chief at Fox News, who also serves as the acting chair of the television pool consortium.
into that memo, he announced that ABC, CBS, NBC and Fox News would all be suspending their pooled coverage of Trump writing, effective today, the TV pool will not be covering events designated as pool coverage of the president.
then adding this follows the White House's position preventing CNN from fulfilling its assigned pool duties, saying there will be no replacement pool put in place. All other pool coverage will continue as normal.
any of the five members of the TV pool also issuing their own joint statement saying the public has a vital interest in receiving accurate, independent information about its government,
saying no administration should restrict a news organization because it objects to its reporting.
But then also beyond that, CNN must now, in Politico have also filed a federal lawsuit against the Trump administration this morning, asking the court to restore their access to the white House ASAP,
any of the outlets specifically claiming that Trump is punishing them purely for the content of their reporting, which is a clear violation of the First Amendment.
then actually in addition to that, the groups also allege that Trump violated their Fifth Amendment rights to due process when he abruptly blocked their access to the white House without notice, arguing,
Constitution does not allow the president or any other government official to deprive the press of their First Amendment rights and liberty and property interests, with no notice or process based solely on his dislike of the content of their reporting.
the lawsuit then going on to argue that Trump's actions go far beyond these three media organizations claiming the ban inflicts an injury on all news media organizations who now risk a similar fate
if they engage in reporting the president deems insufficiently favorable, I think the public at large suffers for however long the unconstitutional ban restricts access to current and complete information about their government.
then Trump, who really seems to be down to talk about anything other than his war in Iran, he hit back on Truth Social this morning, writing in a post, white House is not instituting an assault on the free press, something which I cherish.
It is instituting an assault on the fake news, something that has grown like cancer in our beloved United States of America.
then you also have JD Vance trying to put a similar spin on the situation, though he really ended up fumbling it. So he's not banning media outlets.
What he's doing is saying, we're not going to give you special access to the white House if you engage in what is effectively propaganda.
and actually one of my favorite things about this whole mess is that video, Are you with the white House Rapid Response account sharing that video?
We're saying that there was not a ban as a quote, tweet to their own post where Trump announced the ban?
and it ends up being another case where people in the administration, they're cornered by the president's own words, because like, no doubt about it, Trump himself has repeatedly described this as a ban.

also, Trump saying he cherishes the free press is the most insane fucking like crazy, toxic, abusive boyfriend shit.
Gaslighting I've seen in a minute. right. His entire political image has been about undermining the press. Right.
Literally fake news was one of the first Trump isms that really gained traction when he ran in 2016. He's always going after news outlets. He's personally attacking individual journalists.
he's used federal agencies to censor viewpoints. He disagrees with.
repeatedly refers to the free press as the enemy of the people, which is the same language that authoritarian leaders like Hitler, Stalin and Mao have used to delegitimize the press.
but then beyond the words of experts saying that Trump's efforts right to block access to himself, their unprecedented.
other outlets knowing that this ban goes further than anything that we've seen from him before.
this definitely is not the first time you start to ban news organizations of their journalists from the white House or certain events.
also with us, you have legal experts widely arguing that Trump's ban is blatantly illegal, and there's a past president to prove it.
meanwhile, we're just seeing hilarious footage of some of Trump's events today without the main TV pool. Right?

and then from that, I want to end today's show with some important quick starting with the news that UnitedHealth now has to open its record for the class
action lawsuit that's accusing them of using an AI tool with a 90% error rate to decide whether people get With that lawsuit, saying that in 2019,
UnitedHealth started using an algorithm called NH predict how it would work is that case managers would feed patient data into NH, predict or which would then estimate how long they'll need
care by comparing their case to similar cases from the and you had those case managers saying that by 2023, they were pressured to keep patient stays within 1% of that predicted Otherwise the patient had to pay for care themselves.
And there were a ton of problems with the one that really sticks out is that when the program references those past cases, Apparently it doesn't, or didn't even consider any other complications
that could have added how long those patients needed and so this is all true, the timelines those patients were put a huge chance they weren't even an accurate comparison for their situation.
this lawsuit, it's on behalf of two deceased UnitedHealth beneficiaries. right.
And one of them was a 91 year old man who suffered a fall that landed him in a nursing facility.
but then two and a half weeks into his stay, UnitedHealth allegedly cut him And so his family, they had to pay around $150,000 out of pocket for his care until he passed away a year
and the second beneficiary was 74 and was expected to need about 100 days of skilled nursing care after suffering a but he was cut off after about only 20 days one of his family, they filed an appeal.
And one they then got cut off and so they ended up paying about $70,000 out of pocket before he and so they say this lawsuit, it's to keep other families from going through that type of hardship
alleging that UnitedHealth they've been breaching contracts with members like them to keep more money in the company's pockets.
because a lot of the families dealing with stuff like that, they never actually appealed their and so, for example, in 2021, only 0.2% of members filed an appeal, which meant that the rest of those denials turned into profits.
Reunited that's also where it appears the 90% error rate comes because when they have appealed, they almost always one like 90% of the so you have the plaintiffs saying that the AI tool is blatantly
they claim that UnitedHealth has actually known that all along, but they've used it to help the company hold on to that and while UnitedHealth, they've denied all that, saying that they just use NIH predict as a
The plaintiffs and really many others don't believe them, claiming that they've been stuffing the company's wallet well, the elderly are prematurely kicked out of care facilities nationwide are forced
to deplete family savings to continue receiving necessary medical care, all because an AI model disagrees with their real live doctor's determinations.
actually a key thing here is that the legal team representing the plaintiffs here, they've also brought a case similar to this against that's as we're seeing more and more people in Congress coming after these companies for leaving these life or death decisions up to AI.
but hey words or words and actions or actions.

California apparently folded, and then everyone else decided that battle wasn't worth it if they weren't leading the pack. now that they bowed out. We're getting a few details about the deal as it waits for final court approval.
one, you got the states that were holding out, apparently getting CBS and CNN, an independent editorial board.
the reported goal being a set of politically balanced journalists, no execs or shareholders, Paramount will also reportedly have to put at least 30 films a year in theaters, or they'll get hit with a $30 million fine for each one they miss.
could also have to sell their stake in Miramax as a consequence there as well.
assuming this deal gets approved, this all gets them off the hook for the $7 million daily late fee that they're going to have to start paying Warner Brothers in October. right. So this basically saves them.
because the people worried about how the merger is going to affect competition, the cost to consumers, writers wages and the beef with California AG, Rob Bonta, they were down to the wire on this, But apparently, when David Ellison
started tossing around the idea of moving the company out of Hollywood, lawmakers stop looking so tough.
and you've got reports saying that Bonta was actually starting to be on an island by himself fighting that fight. Or with them apparently abandoned. Many blaming Newsom for this.
And so now you've got many thinking, you know, what actually happens after this merger goes through? because there are a lot of concerns. Job cuts are basically inevitable.
There's also a very real concern about the Ellison's, family that's close to the white House now, sitting at the head of a media conglomerate this massive, among other things.
