This is sandpiper. $72 million defamation lawsuit. It's bigger than a lot of people appreciate. And it could change everything regardless of who wins. Trisha Paytas is now broken.
Her silence on Ethan Klein and the H three cheating scandal. look pretty serious.
Just slammed the government for slandering their son's name and misleading them through the investigation.
With Israel's elections deadlocked, you've got Netanyahu now trying to accuse Arab parties and Israel of stealing the election. talking about all of that and even more on today's brand new Philip DeFranco show.
You daily dive into the news, starting with this.
Hassan Piker is suing CNN's token conservative commentator Scott Jennings for $72.5 million for defamation.
It's a $27.5 million in compensatory damages and $45 million in punitive damages.
Big thing is that the alleged defamation it didn't actually happen on CNN, Instead, it came from Jennings's own show on August 11th, when he played a video for his audience that was put out by the National Republican Senatorial Committee five days earlier.
Or with him saying listen for yourself and understand what the socialists have in store for the black community. kind of what black people care about. All black people care about this. Black people care about that.
Like, shut the fuck up. That's not how politics works. Oh, well, Hassan, how dare you? Like it or not, black people care about this issue.
It's like it's such a fucking stupid stance.
Any other black folk want to engage in radical activist language in this fucking chat? Suck my yes, dude, it's because I'm racist.
That's why. It's because I'm racist, dude. Well, back to a better time when lynchings were happening.
Thing is, though, if you actually go back and watch the original footage, which is clipped together from three separate live streams two years You end up finding that it's actually totally out of context, right?
Either he's responding to a Like it or not, black people care about the border, man. Shut the fuck up. Black people care on the border. I'll give a fuck what black people care about.
Or what you think black people care about. Random anonymous guy claiming. Oh, black people care about the border. Black people care about ice.
You don't know what black people care about. Which is bullshit.
That's not true. or he's reacting to a video of a black conservative debater criticizing woke Diaz. He said we need more Klansmen as these okay.
Can we go back to a better time when lynchings were happening? This is what I like as a black man. Are you always doing too much with black people? Leave them alone.
I want to go back to lynching. Like I get it, but fucking relax, man. Shut the fuck up, okay?
But the clips that were shared by Jennings, it cuts out all the parts that make it clear that Hasan was mocking someone Might these black voters find a home in the Republican Party this fall?
Well, if Democratic campaigns are adopting the piker plan of returning our country to lynchings, that just might happen. the now at the time.
Hassan suggesting he might pursue legal action, though he seemed a little I don't know what opportunities we have for litigation, but it is one of the grossest, like, clip chimps I've ever seen.
This is clear cut. Defamation. But but. Well, now he's. Well, the trigger. He's suing Jennings for defamation. Defamation by implication, and portraying him in a false and a wild fact.
The lawyers that are representing him are some of the same guys who won that billion dollar defamation lawsuit against Fox News for but but still a big thing here is that defamation cases in the United States,
They're almost always an uphill battle, because you have to prove that the defendant had actual right.
Meaning they either knew what they were saying was false, or they showed a reckless disregard for the case, and in this case, you have someone noting that the clips are clearly, misleadingly edited.
But Jennings wasn't the one who strung them so you have some thinking that it's possible he could argue. Hey, I just saw this video on social media. I shared it with my audience and I commented on it.
Nothing illegal But you have Hasan's complaint, arguing that not only did Jennings know that the clips were misleading, he added his own lies on top so and so.
For example, he added a caption quoting Hasan as saying, let's go back to a better time when lynchings were happening, which, according to the complaint, alters a sarcastic question into a
And then, just three days after Jennings spread that supercut, Snopes fact checked him, found the video to be highly misleading, and email Jennings for then, but then, not only did
Jennings fail to respond to Snopes, when Hasan's legal team formally demanded that he retract his comments two weeks later, they claimed that he ignored them as rather, to be clear and specific.
They say that his lawyer acknowledged receiving their promise to respond substantively, but then just never to and to this day, Jennings's posts about Hasan are still up and they've garnered millions of
And then also this video has found its way to the Senate because you had Senator Ted Cruz sharing it last week and here is Abdul Alcides buddy
Hasan Piker calling for black people to be Watch and judge for And so last night you had Hasan quoting that post, attaching the news about his lawsuit against Jennings and saying, hey, Ted, you seen Which sounds like it sound might be suing a U.S.
Senator as the whatever he does on that Ted Cruz front, Hassan appears to have his hands pretty full with Jennings right now. a very costly endeavor.
I'll probably launch a fundraiser for it soon I don't think you should be able to get away with lying like this.
And if I don't put a stop to it, they're going to continue maliciously defaming others as they have done so this entire time.
It's completely unacceptable the way that media and entertainment has merged in this at this point.
And people use these platforms to say whatever they want about their political opposition. right.
-
But then also from that we have to talk about a story that has, I guess, connective tissue.
That's because it involves a san's former podcast co-host and that co-hosts former podcast co-host.
Because you just had the internet's own Trisha Paytas speaking out about Ethan Klein's cheating scandal, and she said that she was relieved that the H3 podcast
Is potentially really, like, ashamed to say that because it's an awful situation, like the way that that had to end.
But I've been praying truly, truly every day for the past five years for like it just to end.
Because in case you missed all the drama, the scandal on Friday, Ella Klein said that she and Ethan Klein are separated because he's been cheating on her for at least six if you don't know them.
There big podcasters who have been together forever. They have three kids together. They built their podcast and companies together.
And the allegations in this whole situation, it just exploded with the H3 podcast going on hiatus.
And actually the H3 crew said that they would no longer work with Ethan and their standing with with Ethan, then posting that he'd be removing his financial stake so that any continued support benefits
Ella in the crew, not And now you've got Tricia responding alongside her husband Moses.
Enable to have some pretty unique perspectives, because as you might Tricia, host of the Front of Me podcast, which was huge for a while with Ethan until they had this absolutely massive falling and they're actually in-laws now, right.
Because Trish's husband is Ella's and so there was this big public on screen and private behind the scenes falling out.
And yesterday you had Tricia saying that because their family, they drew the line after the falling out. Just never talk about Ethan and Ella in public. Right.
In the even saying that in the past, you tried to call a truce between them but received no grace or compassion. so when she saw the new, she It's hard to talk about.
I see a lot of people that were wrong by Ethan, you know, obviously, like celebrating, rejoicing.
You know, I don't feel that way about it, obviously, because it's, again, it's Moses family. We also have kids the same age. Like, I couldn't imagine.
I hate to say that I felt, Like, I just kind of felt relief that maybe it's over. When he announced the podcast was over, it just felt like relief.
Because you're Tricia claiming that Ethan still spewed lies about her and Moses.
And for the last several years, she just lived in a state of anxiety over in fact, he had Moses saying he has had no contact with Ella for five years.
He hasn't spoken to his own sister, and he places a lot of the blame on he did everything he could to destroy my family, and he was successful at that, unfortunately.
And after that, he did everything he could to destroy his own family. And he was successful at that, too.
And when we heard the news, people were wondering, what's the reaction? I want to be a fly on the wall.
I'm like, I was in tears because I read the statement from my sister we're saying, well, he and Tricia learned about the affair at the same time like everyone else and even though they had no clue,
They said that they were surprised by this infidelity, with Moses saying that he tried to tell Ella multiple times that Ethan repeatedly I warned her in the past that he's a liar and he lies.
And, you know, it took like, I don't expect her to choose her brother over her husband.
The amount of lies that exists out there online about me that all come from one source, it's quite unbelievable.
And in one instance, he claims that Ethan said the Moses was a combat pilot who killed people, but Moses said he never even graduated from flight school and wasn't in any kind of But also saying because they decided to
Just fully cut them out of their lives and not discuss them, they said that they had to just take these lies and not defend themselves so as to not start any new But now you have Moses saying that Ethan's no longer family, and so he feels more comfortable speaking out against him.
And you had Tricia I think a big thing to note is Ethan blames everybody for his everything. We got blamed and he blames everyone Friday thing.
If it's us, it's a son. It's whoever.
Think the biggest thing to take away, especially now we can see Ethan's self-destruction, is because of Ethan, and it's always
But also with this you had people looking at the situation noting, you know, Tricia versus Ethan, there's this long, long history of drama and others noting that Tricia and Moses,
They have their own list of controversies as so with that online, depending on where you're going.
You're seeing very split reactions, With some out there incredibly sympathetic and supportive of you then have others saying that she and Moses don't have any ground to stand then you also have others out there saying that all parties involved are then also with this.
If people noting that Tricia, you know, she's not the first creator who's had a big falling out with Ethan that's commented on this are you a decent who previously did The Leftovers podcast with Ethan before they had their falling out writing on Twitter, judge me by my enemies.
And you then Adam adding. It's not a great situation at all. Let's be real. These are.
I mean, there are real lives that are going to be ripped apart by Ethan Klein's selfish,
Narcissistic piece of shit behavior also in the mix, you had Ned Fulmer, the former Try Guys guy that had his cheating scandal sounding
That appearing to be because when Ned was at the center of his cheating scandal, Ethan slammed him and just hate men who have kids. They put their wife through childbirth.
They deliver you two beautiful children, and then you go and cheat on them, bro. that.
That is so sad. It's so up. right.
And that clip actually went viral after people learned about Ethan's cheating scandal and you had people calling him a hypocrite and that appear to include with him posting Ethan Klein can fuck all the way off.
Karma's a bitch, in general, it feels like kind of everyone's been wanting to get their licks and all of that is like, this situation isn't For one, you got a lot of people wondering what is actually going to happen with the podcast.
There's been a lot of talk online about is the crew going to bring back the podcast? Well I'll be there. We'll it involve the other co-host on the other podcast at the platform.
Do they do that? What does it look like? Can that be successful?
That's going to come down to an audience appetite thing and then to there's the Tricia of it you're going to be hearing more from Tricia soon, because she actually has a memoir that's set to come out next month.
While it was obviously written before she learned about this cheating scandal, she said that it does go into her side of the story with Frenemies and how the podcast and so this whole scandal
Is now inadvertently become one of the biggest book promos you could ask but for now, we're gonna have to wait to see how things play then there's even more that we got to talk about in just a minute after a quick break with our sponsor.

Nine months after 37 year old ICU nurse Alex Brady was killed by Border Patrol agents in Minneapolis. His parents say they're being stonewalled and misled by the federal government.
Are you just at the making their first public remarks since their son was killed at an emotional press conference yesterday?
And you had them there calling out the government for spreading ugly lies about Alex keeping them in the dark about this investigation and shielding the agents who killed him.
Federal government went on TV and lied about Alex. They tried to slander his memory to cover up their crime.
Not only was it wrong, it was shameful, unfair and acceptable. It has been a miserable year for our family.
Imagine that your child was killed because of the actions of the government and federal government. Imagine looking at your child had been murdered by watching it on TV.
No one from the government called. You called us that day. They did call us the next day.
Nor the next, nor the next 275 days. We have not heard anything from the federal government.
But what we have been treated to is cruelty. Cruelty from Dan Rosen in the U.S.
Attorney's office, who has stonewalled us for nine months, refusing to share a single update of any kind.
His only words have been, I can't tell you cruelty from the attorney general, Todd Blanch, who told Congress that this investigation would be handled normally and then has ignored our letter.
We sent him begging for basic information the law affords us at every turn.
They have ignored us, misled us, and shielded Alex's killers. This is not normal. This is not justice.
Well, this administration, you know, it's just been a series of horror stories. They're absolutely right. Nothing about this is normal.
While others have been able to move on with their lives after these protests against the immigration crackdown in Minneapolis, Alex Brady's parents, they're stuck in a living nightmare. Their son was a concerned U.S.
Citizen who filmed the agents and helped a fellow protester who'd been pushed to the ground. had a handgun in his waistband that he was legally licensed to carry. for that, the agents wrestled him to the ground.
They pepper sprayed him and they shot him at least ten times in the span of five seconds.
And as if that wasn't horrific enough on its own, the Trump administration that immediately painted him as some kind of crazy domestic terrorist who meant to harm the agents.
That's despite the video evidence making it crystal clear what actually happened.
Had Homeland Security issuing a disgusting statement about his murder, claiming it was a situation where an individual wanted to do maximum damage in massacre. Law enforcement.
By the way, they never fucking retracted. That's still up.
And so while these parents grieve their son, they've also had to deal with these blatant and wildly insulting lies about it.
As you heard them emphasizing at the press conference, the federal government refuses to keep them in the loop when it comes to the investigation Right.
According to this couple, Attorney General Blanch, he's just completely ignored them. And Rosen, the U.S.
Attorney for Minnesota, only agreed to meet with them in July after they'd been reaching out for months.
When he did finally meet with them, he apparently didn't share any basic information.
By basic information, I mean federal officials haven't even shared the identity of the agents who shot their son.
I will note here, you had ProPublica reporting back in February that the officers under investigation are Hazel Cho, a Border Patrol agent, Raymundo Gutierrez, who works for Customs and Border Protection.
With that information apparently coming from a law enforcement official granted anonymity to discuss a continuing criminal investigation. And that is basically all that's been revealed so far.
We're because federal officials have been refusing to cooperate with local authorities in Minnesota, Minnesota's attorney general and the local prosecutors office.
They even sued Trump's Department of Justice back in March, accusing federal officials of refusing to share key evidence about this case, as well as to other shootings by immigration agents in Minneapolis.
While it seemed, hey, like there was finally some progress being made back in July, when you had Hennepin County Attorney Mary Moriarty saying the federal government had started sharing a voluminous evidence into the killings of both Brady and Renee. Good.
After actually examining the material from the Minnesota U.S. Attorney's Office, she realized some information had been withheld.
And so, for example, they conveniently left out the statement that one of the agents who shot Brady provided to federal investigators, in response to Moriarty's filing, US prosecutors said that they were not
Obligated to release further evidence because her office had not yet initiated legal proceedings in the case, with the Trump DOJ saying in a statement the timing is consistent
With how these types of investigations proceed, many just saying this is them doing their best to cover their asses.
Then as far as the response to these parents speeches yesterday, you had the Justice Department saying in a statement to Reuters, communications with family members, if any, come at a later stage of a case
Such as indictment, initial appearance, plea, trial or sentencing, saying these communications do not typically occur during an investigation. which is a response to most people that is completely unacceptable.
And again, the federal government is acting in a way that should not be normalized. state. The obvious. I'm preaching to the choir.
No innocent people should have to be killed by federal agents in the first place. And lying and covering up what's happening on top of that is fucking outrageous.

Represent jumping from that other news. We've got to talk about RFK Jr. Because RFK, I guess he saw Donald Trump's bigotry. And he was like, I got to crank that shit up to 11.
Now, despite, you know, there's really not accountability in this administration. You got people calling for his job over it.
Records in the weeks leading up to the midterms, Trump and several of his most high profile goons, they've spread out across the country to rally Republicans in several key races.
Like Trump making three visits in a month to Texas to try to shore up voters were Ken Paxton against James Talarico, JD Vance campaigning for Mike Whatley in North Carolina to maybe stop it from flipping blue.
But of course, one of the biggest ones is the race for a Senate seat in Michigan between representative Mike Rogers and Doctor Abdul El-Sayed. I will say, if the polls are believed, is gearing up to be a very, very tight race.
And it could be absolutely pivotal for control over the Senate.
And you've had Trump himself and a number of other Republicans, including his opponent, Mike Rogers, taking aim at, I will say, Ed, in a variety of ways, the the most common is attacking his faith
As a Muslim with Trump himself on Sunday calling him a jihadist Muslim Brotherhood member and even suggesting he wanted. I had to go through a metal detector before he's allowed to go into the Senate.
Which I know most of us were, like, numb to it at this point, but fucking insane thing for anyone, including the president of the United States, to say, but it also seemed like the, the normal, if we could fucking call it that, which is an insane thing to say.
Racism from this group, the week was not enough, because at a campaign rally in Grand Rapids, you had Health and Human Services Secretary RFK Jr taking things to a whole different level. Right.
You had him immediately jumping on board with targeting ISIS faith and doubling down on accusing him of having ties to the Muslim Brotherhood.
Right, which, if you're not familiar, is a group that's had several of its chapters designated as terrorist organizations by the federal government.
And actually a key thing about this before we move on else I had has repeatedly and publicly denied any connection to the Muslim Brotherhood and even disavowed them. I've seen Republican politician saying he has.
He won't disavow them on literally videos of him disavowing them.
But as far as with RFK, you know, we seem to be taking a little more open minded approach.
And some of his Republican colleagues, if are saying, hey, Muslim religion produced a golden age, right, in which Islamic lands were the center, the foundation for art and literature
And science and engineering, and they were highly tolerant and pluralistic and cosmopolitan, except from there he immediately takes a turn arguing at the inception of the Muslim Brotherhood as a political movement in 1928, quote created stagnant societies.
Then here is where he just goes all in. There's 500 million Arabs in the world, and yet they don't produce science. They don't win the Nobel Prize.
I don't really feel prize. They don't win Nobel Prize. They don't produce literature to RFK junior just goes full send on the bigotry.
The backlash was fast, and it was spicy, especially because in addition to a number of things, a single little Google search would prove just how wrong he is. like, literally.
Just last year, an Arab man won the Nobel Prize in chemistry for the development of molecular building blocks with spaces large enough that gases and other chemicals can flow through actually, that same guy won the Wolf Prize in chemistry back in 2018.
Also you've got examples like in 2011, a Yemeni journalist, politician and human rights activist was the co-recipient of the Nobel Peace Prize, becoming the first Arab woman to do so.
Then in 2005, 1999, 1994, 1988 and 1978. All ER recipients of Nobel Prizes. right. And I could go on and on. But you get the idea.
RFK appears to be a bigoted piece of shit who is full of shit. you had just countless people online calling him out. Right.
Including Doctor Peter Hotez, a professor at the Baylor College of Medicine who specializes in vaccine development and tropical medicine.
And he actually worked with the late Egyptian born Arab Nobel Prize winner, Ahmed Zewail and responded to RFK comments by saying that he thinks I'm Ed would have disagreed with Kennedy and added. God, rest his soul.
He didn't have to endure this.
And, of course, RFK junior forgets that it was the Arab scientists of the Middle Ages who kept Aristotle, Hippocrates, Galen alive to hand it down to the Renaissance.
You even had calls for RFK to be fired over this with the Council on American-Islamic relations saying Robert F Kennedy Jr's vile anti-Arab rant is a textbook
Display of unvarnished racism and bigotry, saying his sweeping erasure of Arab contributions to humanity is not only maliciously false,
But it also pans the flames of anti-Arab and anti-Muslim hate at a time when communities are already vulnerable to bigoted attacks from other public officials nationwide,
Adding that standing at a stage and dehumanizing millions of people with, quote, fabricated white supremacist talking points is utterly disqualifying for public office.
As far as those ads responded with, as we saw a spokesperson for his campaign accusing RFK Jr of using racially charged comments to stir hostility and anger, especially
Considering that Michigan actually has the largest Arab population in the United States, making up just over 2% of total citizens of the state.
Anyone else like Ed's campaign spokesperson adding It's rich to have an anti scientist come to Michigan to lecture a doctor with two doctoral degrees who has spent his entire career working on public health.
And we haven't yet got any comment from RFK junior regarding all this, he is slated to serve as a special guest of the Make Iowa Healthy Again rally in Des Moines today.
And then there's even more we're going to dive into in just a minute, and I'll be right back after a quick break with our sponsor.

We got to talk about starting with the fact that Israel is now in a political deadlock after nobody got enough votes to form a and so of course, Netanyahu, he has a scapegoat to try to stay in power,
The them, writing in a post today, the elections in the State of Israel were stolen by Arab parties that support terrorism and the elimination of the Jewish state
Through serious criminal offenses of bribery, threats, violence, forgeries, and the use of prohibited software to mobilize voters.
And this multiple paragraph long tirade, he blamed Israeli Arabs, the election results, and called it a serious blow to Israeli democracy and demanded that agencies act, quote, with an iron fist.
I'd say that this was a shocking, crazy development if it wasn't for the fact that Netanyahu has blamed Arabs for is also a crazy, horrifying strategy because they make up 20% of Israel's population.
And the election showed that with them coming out way more than usual to vote and help the Arab led parties to secure around 18 to 19 seats, according to exit
That makes them a serious player, and getting a coalition government going as a block would need 61 seats. ran again. Netanyahu.
He claims this was done through blatant bribery and corruption and even alleged that they have evidence, though the public hasn't seen it while Israel's Central Elections Committee confirmed that it's reviewing
The claims, they earlier noted that there were no signs of systemic So that ends up being a bad sign for Netanyahu, despite the fact that his block looks like it barely has the most He still needs that clear majority, and he's pushed for a right wing coalition.
But the group under Bennett has long hated Netanyahu, so that might not right.
And if he can convince them or the Arab parties or almost anyone to join forces, they might be able to oust Netanyahu, albeit with a fragile but now, like we said, would happen.
We're in this extremely hypothetical anything could happen space.
And there's just too many moving parts with experts thinking that they're going to be weeks of negotiations and then also in the news, we need to talk about how last year, 21 year old Navy sailor Angelina was strangled to death by a fellow sailor in his barracks at Naval Station Norfolk.
-
Then hit her body for days before dumping it. And he pleaded guilty to her murder and is now serving more than 40 years.
But you now have this new investigation from The Intercept saying that her case points to a much bigger problem. military may be undercounting killings like hers by nearly half.
So they found that over six years. The Pentagon reported 41 domestic abuse related homicides by service members.
The Intercept identified nearly twice as many, at least 73 cases, almost all of them women And their key point was if a killing isn't properly recorded, it's as if it never happened, which makes the problem impossible to actually fix.
You got Angie's family saying the Navy failed her mom told The Intercept that she got conflicting, delayed, and false information for a week while she searched for her daughter, who was already dead.
Well, the Navy says that proper procedures were followed, they admit that several of them need review, and it since changed some policies.
This isn't over on several fronts, including since her death, and his mom's been fighting to force the military to do and then finally today, we've got to talk about updates with Brazil because it's actually now made its way into the United States.
-
We're because after losing the presidential election to Lula and refusing to concede, Flavio Bolsonaro apparently fled Brazil, and now he and his family have reportedly been granted visas to stay in the United States.
This is huge news for a number of reasons, including he's been under investigation for tax evasion, corruption and notably, money laundering in Brazil.
With that, reports say that ten federal police officers surrounded him outside of his father's house to give him a court order, saying he had to surrender his passports and was barred from leaving the country.
When that first happened, he was saying he'd never even thought about leaving, claiming that he'd hand over his passports and defend himself against what he saw as a clear attempt to intimidate him.
But at some point, maybe because his parliamentary immunity went down the drain with his lawyers, you had sources saying he got scared that he'd find himself in handcuffs within the next week. and so we missed the deadline to give up his passports.
And then the next thing you know was on Tuesday, reports said that he went to Argentina with his wife and daughters, boarded a private plane to Ecuador. And by this morning he was in Miami. where we live.
Look on the whole thing. Shameful. Claiming a person who sneaks out of their country must have something to hide.
And you had sources saying that Brazilian officials have been warning the US to not let him in.
Saying that with his legal issues, if he's charged and convicted, he'd be subject to extradition.
But also now, on top of whatever trouble we could see there, you also have reports saying that this could add to the growing rift between the United States and Brazil.
Because Brazilian officials, they were already accusing the Trump administration of colluding with Bolsonaro and his family to put them back in power.
I mean, just this week you had a Brazilian judge ordering an investigation into a donor network co-founded by JD Vance, alleging it may have helped his campaign.
I also mentioned with you earlier this week, even outside of this election, specifically, you've had people calling Trump out for trying to push Latin America further to the right.
But even with all the attention growing, before you even got here, you had Trump saying he'd approve of Bolsonaro coming to the US.
With Trump saying that Bolsonaro is are fine people and also throwing doubt on the election, which at this point is to be expected when, you know, one of his guys don't win. definitely something we're gonna have to keep our eyes on.
Then my friends. It brings us to the end of your Wednesday, Philip DeFranco show. you for being a part of another daily dive into the news. my God. Only three more shows until we know what happens on the election.
Then we see whatever the hell happens from in the meantime, if you want to start the show, hit us with a like. If you're not subscribed, do that. You can also sign up at Philip defranco.com.
There's probably other stuff I got it in the description.
My brain no work, it too great by the time that I'm about to finish the you should definitely check out this video as well.
And no matter what you do, I'll see you right back here tomorrow for another dive into the news.
